AGB - Terms an Conditions
These Terms and Conditions govern the contractual relationship between Krug and Hecking (SOUNZZ) GbR, Mühlenbergstraße 33B, 87448 Waltenhofen, Germany (hereinafter referred to as “Provider”) and the users of the website www.bam-sound.com (hereinafter referred to as “Customer” or “Licensee”).
1) Scope of Application
These Terms and Conditions apply to all contracts, deliveries, and services concluded via the website www.bam-sound.com between the Provider and the Customer. Deviating terms and conditions of the Customer will not be accepted unless explicitly approved in writing by the Provider.
2) Subject Matter of the Contract
The subject of the contract is the paid licensing of digital music tracks offered on www.bam-sound.com. Upon purchase, the Customer acquires a non-exclusive, non-transferable license to use the respective music track for their own projects in accordance with the agreed terms of use. Resale or sublicensing is prohibited.
3) Copyright and Usage Rights
All offered music tracks are protected by copyright. Copyright remains with the Provider or the respective composers. By purchasing a license, the Customer obtains a simple, worldwide, and perpetual right to use the music track for their own purposes. Editing, duplication, distribution, or public performance is only permitted within the scope of the license terms.
4) Obligations of the Customer
The Customer agrees to use the purchased music tracks exclusively in accordance with the license terms and not to engage in any actions that violate applicable law or the rights of third parties. Use in illegal, discriminatory, pornographic, or violent contexts is prohibited.
5) Exclusion of the Right of Withdrawal
Since the content provided consists of digital goods made available to the Customer immediately after purchase, there is no right of withdrawal in accordance with §356 (5) of the German Civil Code (BGB). The right of withdrawal expires upon the start of the download.
6) Liability
The Provider’s liability is limited to intent and gross negligence. In cases of slight negligence, the Provider shall only be liable for breaches of essential contractual obligations (cardinal obligations). In any event, liability is limited to the amount of the license fee paid by the Customer. Further liability, particularly for loss of profit or consequential damages, is excluded.
7) Final Provisions
The law of the Federal Republic of Germany applies. The place of jurisdiction is Kempten (Allgäu), Germany, where legally permitted. Should individual provisions of these Terms and Conditions be invalid or become invalid, the validity of the remaining provisions shall remain unaffected.
